If your Private Identifiable Information was potentially accessed during the July 2023 Data Incident affecting limited portions of Bradford-Scott Data LLC's network (BSD), including those who were sent a notice letter by BSD concerning the Data Incident, you may be a Class Member and eligible for Settlement Benefits. Excluded from the Settlement Class are: (i) Defendant BSD, any entity in which Defendant has a controlling interest, and Defendant’s officers, directors, legal representatives, successors, subsidiaries, and assigns; (ii) any judge, justice, or judicial officer presiding over this matter and members of their immediate families and their judicial staff; (iii) all individuals who make a timely election to be excluded from this proceeding using the correct protocol for opting out; (iv) the attorneys representing the Settling Parties in the Litigation; and (v) any person found by a court of competent jurisdiction to be guilty under criminal law of initiating, causing, aiding, or abetting the Data Incident, or who pleads nolo contendere to any such charge.

If you are a Class Member and wish to receive Settlement Benefits then you must submit a Claim Form by October 7, 2026.

BSD will establish a Settlement Fund of $2,393,888.25. The Settlement Fund will first be used to pay court-approved attorneys’ fees and costs, Service Award payments for the Plaintiffs, and the costs of administering the Settlement. The net remaining money will be used to pay for the benefits described below.

Credit Monitoring. All Class Members are eligible to enroll in three (3) years of CyEx Financial Shield Complete. This comprehensive service comes with $1 million of financial fraud insurance, and includes monitoring for:

  • fraud or identity theft

  • unauthorized financial transactions

  • personal information associated with high-risk transactions

If anything, suspicious happens, you will be able to talk to a fraud resolution agent to help fix any problems.

Documented Monetary Losses. Class Members who incurred actual, documented out-of-pocket losses due to the Data Incident, can get back up to $5,000.00. The losses must have occurred between July 2, 2023, and October 7, 2026, and you cannot claim a payment for expenses that have already been reimbursed by a third party. This benefit covers out-of-pocket expenses like:

  • losses because of identity theft or fraud

  • fees for credit reports, credit monitoring, or freezing and unfreezing your credit

  • cost to replace your IDs

  • postage to contact banks by mail

You need to submit third-party proof, like bank statements or receipts, to show how much you spent or lost. You can also provide notes or papers you made yourself to explain or support other proof, but those notes or papers alone are not enough to make a valid claim. Your proof or notes should show that your expenses were because of the Data Incident.

Pro Rata Cash Payment. Class Members may also claim a one-time pro rata cash payment. This payment is expected to be $100.00, but may be larger or smaller depending on the total claims filed.

It is expected that a significant amount of money will remain in the Settlement Fund after all expenses and all other benefits have been paid. All of this remaining money will be divided equally between everyone who claims a Pro Rata Cash Payment.

For more information about each of these benefits, please review the Notice, FAQs and the Settlement Agreement.
